In regards to the bunk "COMPLAINT" forms the "prosecutor" forced on us at Freedom Fest. 9am December 12th, 2008 2nd floor 3 Washington St. Keene We'll meet downstairs in the lobby around 8:40am.

So the prosecutor wears a uniform identical to the one worn by city police?
Does he wear it in court?
I'm curious about what happens when he is the only witness in a case - does another lawyer step in for him?

The prosecutor is a police officer. As is the state prosecutor a state trooper. The man who pulled over David Krouse for his infamous registration violation was also the prosecutor of the case against him. I think he wears a suit in court if I remember correctly.

I had a meeting with Eli about this situation. He was very reasonable and told me that he would not be moving forward with the case, but I may need to still appear in court. I explained to him that my work schedule is very hectic and it is difficult for me to take time off. He was understanding and told me he would talk to the court clerk about me not having to appear. If I do need to appear it will not be on the 12th as I cannot take any time off of work right now.

Oh, I suspect the prosecutor just got right up here on this very forum, read the Keene Freedom Fest thread, and realized the charges would never stick.

I'm happy for both of you.
There really isn't enough information to say for certain why they backed down. There could be more than one factor. It wouldn't surprise me if the fact that Toby is a local had something to do with it.
